1. Acceptance of Terms

Welcome to Jewelixy. These Terms of Service ("Terms") govern your access to and use of the Jewelixy website located at jewelixy.myshopify.com (the "Site"), and all products, services, features, content, and applications offered by Jewelixy (collectively, the "Services"). By accessing, browsing, placing an order through, or otherwise using the Site or Services, you ("you," "your," or "Customer") agree to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue use of the Site and Services.

These Terms constitute a binding legal agreement between you and Jewelixy. They apply to all users of the Site, including without limitation browsers, vendors, customers, merchants, and contributors of content. We reserve the right to update, modify, or replace any part of these Terms at any time as described in Section 14 below. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

3. The Store and Products

Jewelixy operates an online store offering jewelry and related products. We make reasonable efforts to display, describe, and price our products accurately, including product descriptions, specifications, images, materials, dimensions, availability, and pricing. However, we do not warrant that product descriptions, images, pricing, availability information, or other content on the Site is accurate, complete, reliable, current, or error-free.

Product images are for illustrative purposes. Actual product appearance, color, size, and specifications may vary from images displayed on the Site due to photographic lighting, screen settings, manufacturing variations, or other factors. If a product you have ordered is unavailable or discontinued after you place your order, we will notify you and provide a full refund of any amounts charged for that product.

When you place an order through the Site, you are making an offer to purchase the products in your order subject to these Terms. All orders are subject to acceptance by Jewelixy. We may, in our sole discretion, refuse or cancel any order for any reason, including but not limited to: product or service availability; errors in product or pricing information; errors in your order; suspected fraudulent, unauthorized, or illegal activity; inability to verify or authenticate information you provide; payment authorization failure; shipping or delivery restrictions; or violations of these Terms.

Your receipt of an order confirmation email or order number does not constitute our acceptance of your order. Jewelixy reserves the right to contact you to confirm details of your order, to request additional information, or to inform you that we are unable to fulfill your order. Order acceptance occurs when we ship the products to you or otherwise notify you that your order has been accepted.

If your order is canceled after your payment method has been charged, we will issue a refund to your original payment method. Orders are generally processed within approximately 1 to 2 business days following successful payment confirmation. We will make reasonable efforts to accommodate cancellation requests received before the order has been shipped, but we cannot guarantee that cancellation will be possible once processing has begun.

5. Pricing and Sales Tax

All prices displayed on the Site are in United States Dollars (USD) and are exclusive of applicable taxes unless otherwise stated. Prices are subject to change at any time without notice. We make reasonable efforts to ensure that pricing information is accurate, but errors may occur. If we discover a pricing error on a product you have ordered, we will notify you as soon as practicable and give you the option of reconfirming your order at the correct price or canceling your order for a full refund.

Applicable sales tax will be calculated and added to your order total at checkout based on the shipping destination and the taxability of the items you purchase. Jewelixy does not store your complete credit card or payment account information on our servers. You agree to pay all charges incurred by you or on your behalf through the Site, at the prices in effect when such charges are incurred, including all applicable taxes.

We reserve the right to refuse or cancel any order if we suspect fraudulent, unauthorized, or illegal activity associated with your payment method or account. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms, and you will be responsible for all costs of collection, including reasonable attorneys' fees.

7. Shipping and Delivery

Shipping within the United States is FREE for all orders. Delivery times, shipping methods, restrictions, and additional details regarding shipment of your order are described in our Shipping Policy, available on the Site. Please review the Shipping Policy carefully before placing your order.

Orders placed through Jewelixy are generally processed within approximately 1 to 2 business days following successful payment confirmation. Estimated delivery times are typically 3-5 business days within the United States from the date of shipment. Delivery estimates are not guaranteed and may vary due to weather conditions, transportation interruptions, shipping carrier delays, public holidays, operational disruptions, inaccurate shipping information provided by you, or other circumstances beyond our reasonable control.

You are responsible for providing accurate and complete shipping information. Jewelixy is not liable for delays, non-delivery, or additional costs resulting from incorrect, incomplete, or outdated shipping addresses provided by you. Risk of loss and title for all products purchased pass to you upon delivery to the shipping carrier. We encourage you to track your shipment using the tracking information provided in your shipment confirmation email.

8. Returns and Refunds

Customers may return eligible products within 30 days after delivery in accordance with our Return and Refund Policy, available on the Site. Please note that there is no statutory cooling-off period or right of withdrawal for online purchases under United States federal law. The 30-day return window is Jewelixy's own policy and is subject to the conditions and exclusions described in our Return and Refund Policy. The Jewelixy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jewelixy or its affiliates or licensors. You may not use such marks without the prior written permission of Jewelixy. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

Subject to your compliance with these Terms, Jewelixy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Content solely for your personal, non-commercial use. You may not: (a) reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content, except as incidentally necessary for normal viewing of the Site; (b) use any Content for commercial purposes or for the benefit of any third party; (c) remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on the Content; (d) use any robot, spider, scraper, or other automated means to access the Site or Content; or (e) frame or link to the Site without our prior written permission.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JEWELIXY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. JEWELIXY DOES NOT WARRANT THAT: (A) THE SITE OR SERVICES WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SITE OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SITE OR SERVICES WILL MEET YOUR REQUIREMENTS.

JEWELIXY DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE OR ANY HYPERLINKED WEBSITE, AND JEWELIXY WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF WARRANTIES OR LIMITATIONS ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU IN THEIR ENTIRETY. 12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JEWELIXY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF JEWELIXY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JEWELIXY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO JEWELIXY FOR PRODUCTS OR SERVICES DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES,
